Why do you need to appoint an authorised representative for the extended producer responsibility in Belgium?

The European Battery Regulation 2023/1542 requires foreign producers who make batteries available on the Belgian market to appoint an authorised representative for the extended producer responsibility (EPR) in Belgium. Find out what this involves, why it’s necessary, and how to do it. 

 

What is the extended producer responsibility? 

As a battery producer, you are required to comply with the EPR, which comes with several legal obligations. This includes registering with the regional governments, declaring the batteries you make available on the market, demonstrating your recycling efficiency, and more. Read more about the EPR here. 

Following updates to the European Battery Regulation 2023/1542, foreign producers must appoint an authorised representative who will fulfil their EPR obligations on their behalf in Belgium

Who can act as the authorised representative? 

The authorised representative is appointed by the producer to take on their EPR obligations in Belgium. The representative must be: 

  • a natural or legal person
  • with a Belgian address
  • registered with a Belgian company number

As a Bebat participant, you can either appoint a third party or choose to have Bebat take on these obligations on your behalf. If you choose Bebat, an annual fee of €750 applies. 

How do I appoint an authorised representative? 

To ensure our participants comply with the regulations, Bebat provides the necessary documents to appoint an authorised representative. The process is as follows: 

For new participants 

  • During registration on MyBebat, you will be asked to appoint an authorised representative
  • If you choose Bebat, you can sign the contract immediately. 
  • If you choose a third party, you can download the Bebat template during registration, complete it, sign it yourself, have the third party sign it, and then upload the document. 

For existing participants

  • Soon you will receive a message via several communication channels asking you to appoint an authorised representative. These notifications will also appear in MyBebat. 
  • You can click through and indicate online who you wish to appoint as an authorised representative
  • If you choose Bebat, you can sign the contract immediately. 
  • If you choose a third party, you can download the Bebat template, complete and sign it yourself, have the third party sign it, and upload the document.
